Which contracts does this information cover?
This notice concerns contracts concluded away from business premises or at a distance between consumers and DeSH Real Estate GmbH for estate agency services or other services, where a statutory right of withdrawal exists under section 312g of the German Civil Code (BGB) and no special rules for financial services apply. A consumer is a natural person acting predominantly for purposes outside their trade, business or independent professional activity.
Contacting us or making a non-binding enquiry does not, by itself, create a paid estate agency contract. Whether a contract is concluded depends on the parties’ actual declarations and the statutory form requirements. Under section 656a BGB, an estate agency contract for identifying or brokering the purchase of an apartment or single-family house must be made in text form.
A loan agreement with a bank is separate from an agreement for loan brokerage or advisory services. Special withdrawal and information rules may apply to loan agreements and other financial-service contracts. The statutory rights and documents relating to the particular contract govern; this general notice for services does not replace a separate notice where one is required. If an external valuer, such as Betongold, is engaged, please also note the contractual party named in that engagement.
Withdrawal notice for consumers
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date the contract is concluded.

of your decision to withdraw from this contract by a clear statement (for example, a letter sent by post or an email). You may use the model withdrawal form below, but you are not required to do so.
To meet the withdrawal deadline, it is sufficient to send your statement exercising the right of withdrawal before the withdrawal period expires.
Effects of withdrawal
If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (except any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days after we receive your statement of withdrawal. We will use the same means of payment that you used for the original transaction unless we expressly agree otherwise with you. You will not incur any charge for this reimbursement.
If you requested that the services begin during the withdrawal period, you must pay us a reasonable amount proportionate to the services already provided up to the time you inform us that you are exercising your right of withdrawal, compared with the full scope of the services specified in the contract.
End of the withdrawal notice
Early start of services and expiry of the right of withdrawal
For a service contract that obliges you to pay a price, the right of withdrawal expires when the service has been fully performed if, before performance began, you expressly agreed that we could start before the end of the withdrawal period and confirmed that you understood your right of withdrawal would expire once we had fully performed the contract. For a contract concluded away from business premises, that agreement must also be communicated on a durable medium (section 356(5) BGB).
Merely reading this page is not such an agreement. An early start alone does not automatically end your right of withdrawal. Any obligation to pay for services already provided depends on the applicable statutory requirements; this information does not create an additional right to remuneration.
